Bankrupt Ray Mackereth loses Q News & White Wolf

The tribute team at RayMackereth.com have known for a while that our ‘hero’ Ray Mackereth has worked as a council bus driver. Honest work for an honest day’s pay. More power to him.

So that should have been the end of. Of course, it should have. But this is Ray Mackereth,  not your everyday hero.

Mackereth sold or lost most of his assets after he lost a Federal Circuit Court case brought by a former employee and then he declared bankruptcy cheap date lyrics . This included his shares in http://thelakotaculturalexchangeprogram.org/category/guests/  Q News Pty Limited that owns enter Q News Magazine, now run by the fabulous all round good guy Richard Bakker and his brand new team of editors and contributors.

When our hero Mackereth sold and transferred his shares to Mr Bakker, also went his legal access to the Dance Party physical and intellectual property assets of Brisbane White Wolf, including websites and branding.

Co-founders of Brisbane White Wolf Brenton Larcombe and Deeje Hancock from Number 29, are the new controllers of the White Wolf brand after a deal was made to resurrect the parties.

Deeje and Brenton are bringing the party back this weekend. But alas, as White Wolf now takes off under new leadership, some sad, sad, sad, sad, sad, (but anonymous) person has said “an event claiming to White Wolf and using our branding

Oh, Puhhhhhlease, let’s go to some forensics, shall we? Also note the words above are all plural “WE”, “We, “we”, “our”. Not I, or my?

Q News Pty Limited owns www.whitewolf.net.au as shown by the AusRegistry. Sources have told RayMackereth.com that there may be some lighting and sound equipment that may still be floating around with a curious custodian, but that, of course, is a matter for the bankruptcy trustee, not a humble tribute page.

The White Wolf branding above was once owned and paid for by Q News Pty Limited and so when Mackereth sold and transferred his shares to Mr Bakker just weeks before declaring bankruptcy, he also lost access to this branding and the new director of Q News has shared the intellectual property assets with two of the original three founders of White Wolf.

If it was the case that Mr Mackereth continued to use the branding of his former company and its branding and those pesky lights, he, of course, would have had to disclose that to the public trustee and an undischarged bankrupt.

Indeed Mr Mackereth’s own ABN search shows that he is no longer the owner/user of any business name or trademarks of White Wolf (or even a Black Sheep as it turns).

What the same searches do show is that Number 29 Pty Limited does have a registered business name of “White Wolf Brisbane”. You may know Number 29 better as the award-winning men’s SOPV venue that arose from Ray Mackereth’s very own gutting of the old Klub Kruise when he was the sole director of it.

Klub Kruise crashed under massive debt and liquidated because it owed the taxman and other creditors (including Mr Larcombe) over $150,000.

Speaking of Mr Larcombe, he is the sole director of Number 29 Pty Limited which is the new owner of White Wolf Brisbane. Larcombe’s partner and co-manager of Number 29, David (Deeje) Hancock is the registrant’s contact for Whitewolf.net.au that used to be controlled by Mr Mackereth when he still had a relationship with Q News.

So after all this boring corporate stuff, here is what makes it SAD! Q News Pty Limited owner Richie Bakker went online on 31 March 2018 to disabuse the sad, sad, sad, sad, sad, (but anonymous) posting that there was not White Wolf this easter in Brisbane.

Bakker thundered back saying:

“What a load of rubbish. White Wolf has changed hands due to stupidity and neglect.  (Ouchies). The previous publisher needs to accept this and move on.”

 

The last White Wolf that had anything to do with Mackereth was in October 2016 – when he was bankrupt.

Fun fact, the old, Brisbane White Wolf FB page that suggests the last event was all the way back on 2 October 2016.

But before we go, and while we are not saying the sad, sad, sad, sad, sad, (but anonymous) poster to the old Brisbane White Wolf page is Mackereth, and others such as Mr Bakker seem to suggest.

So let’s go our favourite bits from the online rant in full glory below.

  • “Imitation is the Greatest form of Flattery”. Another fun history fact: Brenton Larcombe, Ray Mackereth and Deeje Hancock created White Wolf on Brenton’s 40th and collectively build the event up. So no imitation, rather White Wolf is just back in hands of two of the three founders.
  • NO headline interstate DJ“. Misconceived belief the interstate DJs are somehow better than local talent. Hmmmm.
  • “No excellent venue”. Uh huh. We guess a venue that is all kitted out with equipment owned by the promoters ain’t all bad.
  • No large sound and lighting system” – nor was there when the bankruptcy sheriff arrived at Paddington – but more of that later old chap.
  • “No Community Benefit” and look we know you are flogging a dead horse, but it is simply not cool to not pay taxes, super, long service leave and divert those funds to allegedly “community events”.
  • “We apologise if you have been mislead (was that meant to be “misled” old chap?) by others and yes it is sad what some people will do.” Oh, Oh, Oh, without a hint of irony, a failed event promoter who literally only has the FB page which Q News rightfully owns access to, is calling the rightful owners “sad” while being a keyboard warrior to try to wreck the very event Mackereth lost only because of his insolvency.
  • We don’t know, we will try our best to find out” was written in the old Brisbane White Wolf post comments, when someone asked how the mailing list got to him. Speaking of LOLS, there is no mystery. Q News Pty Limited owns the site and the lists and WWB does not. No mystery. It is just what happens you go bankrupt. You just don’t own stuff any more old chap. We wonder why the old WWB commenter would not be candid about the cold reality. SAD!

Now, now, now, Raymackereth.com can’t say that when the post refers to “We” or “Our” it really means “I” or “my”. But we do note that is a similar Qmunity theme, eh “fellas”?

By the way, we were happy to not have our hero pictured tucking into a Taco Bell meal on the bus run, as an honest day’s pay is just that.

But it looks like there still may be some personal reflection needed by the big man about what it is like to let go and grow from your failings.

It really does have an “If I can’t have it, no one can” feel about it, doesn’t it? Why is that feeling so familiar?

Ray Mackereth and sole shareholder of Q News filed for bankruptcy on 17 September 2015.

It is all over. The for sale sign will be put up on Ray Mackereth’s Q News shares.

The failed sex king can no longer remain a director of Q News Pty Limited and his shares sold. The mansion lease is now an asset for the trustee to dispense of as Ray Mackereth files for bankruptcy.

Mackereth will have to step down from the board of the public company Gay and Lesbian Travel Association (GALTA) if he hasn’t already.

The failed sex-club king who claims to be a champion of 120 charities recently successfully won a crowd-sourcing campaign for $20,000, claiming “QNews saved! Thank you people!”

As the sole director and shareholder of Q News, Mackereth can now add failed publisher and bankrupt to his name as the trustee can now sell his controlling interest in the fortnightly gay-male targeted pamphlet.

Between Klub Kruise and his own personal dealings, Mackereth amassed debts of over $270,000 that he did not pay, including to small businesses, employees, contractors banks and the Commonwealth and soon Q New’s liabilities will become clear.

Mackereth is at the unedifying end of years of corporate malfeasonance and being admonished by a Federal Judge in Larcombe v Mackereth [2015] FCCA 2646 (1) and now the big man, the Controller is now in the hands of the Trustee Ray Mackereth’s Bankruptcy Petition.

HERE IS THE DELICIOUS JUDGEMENT IN ALL ITS GLORY.

In a savage judgement from the bench, Federal Circuit Court Judge Michael Jarrett admonished the failed sex-boss Ray Mackereth, who copped it more than the trashiest tweaked out random at his former sex-den.

In two blows on the one day, (a fair result for any guest at his old sex-space),  the self-proclaimed community champion Mr Mackereth was threatened with contempt over a bizarre gesturing to his mini-me Toby Longhurst while being cross-examined.

The second blow came when Judge Jarrett repeatedly referred to Mackereth’s behaviour as being “outrageous”, and finding he deliberately acted to contravene the Fair Work Act.

In rejecting his credibility on the stand, Judge Jarrett said Mr Mackereth “made up” evidence and when busted, that he had “no contrition”.

Judge Jarrett was scathing of Mr Mackereth’s corporate behaviour, in finding he was an accessory to serious contraventions of the Fair Work Act, ruling his conduct was “the antithesis” of fair work laws.

Judge Jarrett ordered Mr Mackereth to pay Mr Larcombe over $12,000 in compensation, and ordered over $2000 in fines be paid directly to Larcombe and not to the Commonwealth.

Then out the front of the court house, Mr Mackereth, in his second bizarre act for the day, growling in a guttural scream, he then charged into Brisbane workplace litigator Miles Heffernan from Employment Advisors, who had been working closely with Mr Larcombe during the trial process.

Mr Heffernan said “We support our clients to get results. We are patient – especially with crooks that misappropriate their staff’s entitlements to pay their bills and fund extravagance.

“Mackereth threw both a solicitor and counsel at this problem and it was all for nothing – justice prevailed. While we can help, the real hero here is Brenton Larcombe who eyeballed the bloke who lived off his retirement and holiday funds, while his barrister Peter Kronberg made objection after objection and fought to keep evidence out that showed his client for the louse that he is.

“But Larcombe still won and Mackereth chucked a tanty out the front of the court house. The shame of it all.

Larcombe is back in court in December this year for the final stage of litigation against Mackereth, where this time he is being pursued for unpaid long service leave and superannuation.

On 16 October 2014 Mr Mackereth foresaw this week’s trial in very different circumstances, and goading the self-represented Brenton Larcombe, after a set-back on procedural matters, writing “It could not have been a clearer victory” and appearing to imply that witnesses had something to fear from “being subject to cross examination”.

As it turns it was Mackereth himself who had something to fear, as his nearly four hours in the witness box, was marked by inconsistencies, including Judge Jarrett rejecting some of his evidence as “made up”.

Judge Jarrett also rejected Mackereth’s sometimes graphic explanations of his claimed ailing health, finding he set on a course of conduct to “deliberately” deprive Mr Larcombe of his basic entitlements and scolding the fallen sex-boss, calling his behaviour “outrageous” because he “paid ever other other employee” other than Larcombe.

In a tragic defence, Mr Mackereth’s counsel Peter Krongberg tried to argue his client was the victim because Mr Larcombe registered Number 29 Pty Limited a month after he understood Mr Mackereth resolved to wind Klub Kruise up. Judge Jarrett knocked that down calling it a “red herring”.

Kronberg and Mackereth have some history, where back in 2013, Q News published a story claiming “Peter is one of the best in his game with a dam (sic) good reputation for winning cases”.

In this case, Mr Kronberg lost against the self-represented Larcombe, which may not help the “dam” good reputation. Conversely Larcombe must be delighted that he won against “one of the best in (the) game”.

Mackereth’s October 2014 Facebook post also claimed “now I can get on with my life and focus on things that matter, like continuing to work with 120+ community groups…”, but with another trial in December 2015, that appears unlikely.

Mr Mackereth still remains living in a mansion at Paddington, while claiming to be a philanthropist. Now a judge has called him on that narrative.

Mackereth has 28 days to appeal or pay the judgement including the fines, before having default judgement entered and possible bankruptcy.

Ray Mackereth serves up lashings of Christmas irony

With the presses running at a fever pitch this fortnight at Q News pumping out their almost tome-like latest issue of 32 pages, publisher Ray Mackereth could almost be forgiven for not realising the immense irony of an article as it went to print.

Almost.

Demonstrating a remarkable lack of consideration of how it may be received by many of its readers, Mackereth published a review of the movie Horrible Bosses 2.

The movie which is currently screening in cinemas follows the comedic misadventures of a group of friends who have suffered various stresses and personal setbacks due to outrageous and unacceptable workplace behavior from their employers.

It was not all that long ago that Mackereth himself accepted to WorkCover Queensland that his management style caused to break his staff member’s spirit which including heavy handed management.

The colourful Brisbane publishing identity has also appointed counsel to defend a criminal case against him which is currently before the Industrial Magistrate for unpaid wages which is being heard on 30 January 2015. Mr Mackereth faces unpaid wages claims of over $40,000 and fines in excess of $60,000 between this case and one under the Fair Work laws federally.

Sources close to Brenton Larcombe, who has commenced the criminal case tell us that his sense of irony is as sharp as ever, and that this unfortunate coincidence has given him a reason for a giggle in what has otherwise been a stressful period.

Miles Heffernan from workplace litigation firm Employment Advisors who is acting for Mr Larcombe in the criminal offences matter brought under special laws in the Queensland Industrial Relations Act, said that the irony was “delicious” adding “just as well it is Christmas as this gift is so exquisitely timed.

Ray Mackereth now faces criminal offence for non-payment of wages

Brenton Larcombe has commenced a private prosecution against Ray Mackereth and if found guilty, he risks a conviction being recorded and a fine of up to $20,000 issued by the Industrial Magistrate, for unpaid long service leave of $13,000, court documents show.

The action is in addition to a civil action taken by Mr Larcombe in the Fair Work Division of the Federal Circuit Court, where Mr Mackereth faces further claims from unpaid annual leave, notice and superannuation of $28,000, bringing the total claim to $41,000 and exposing the failed sex boss to penalties of more than $50,000.

Despite the gay sex on premises venue Klub Kruise closing owing $190,000 to its employees, suppliers and the ATO, Mr Mackereth remains a director of gay and lesbian publisher Q News and the Gay and Lesbian Tourism Association (GALTA).

On 16 October RayMackereth.com reported that Mr Mackereth claimed that a pre-trial hearing left him to claim “it could not have been a clearer victory” and that it would be “an unlikely event” that the case would continue.

That “unlikely event” has now happened, where Larcombe filed a further amended claim (read it here: Larcombe Further Amended Claim) with the Federal Circuit Court and doubled down with an extra claim with the state-based Queensland Industrial Magistrate.

Sources close to the Larcombe camp have told Raymackereth.com that he has had some help from a leading labour law firm that acts for some of the country’s biggest unions.

This  resulted in an expanded claim and forcing Mr Mackereth to now defend two actions, one state and the other federally, including the long service claim being dealt with as a criminal matter, as an offence under the Industrial Relations Act.

Mr Mackereth does not deny that the money has never been paid to Mr Larcombe, nor has he apologised to Mr Larcombe.

Despite admitting being “solely responsible for the corporate behaviour” of Klub Kruise, Mr Mackereth argues that he should not be personally liable for the actions of his company that employed Mr Larcombe, that he was the sole director and 80 per cent shareholder of.
